HMRC Consultation & KPMG WebEx: Off-Payroll Working in the Public Sector

Universities will be affected by the proposed legislation forcing public sector organisations to determine whether workers employed by Personal Service Companies they engage are effectively acting as employees in providing services, and then account for income tax and employer and employee NIC accordingly.

HMRC has now launched a consultation regarding off-payroll working in the public sector. The change to engaging people via limited companies was announced in the Budget, and HMRC had previously issued a discussion document on this topic. BUFDG met with them to discuss it and submitted this response, based on members’ feedback. We would also like to respond to the full HMRC consultation. As ever, we want to ensure we are representing members’ views as accurately as possible, so please let me know what you think about the proposals by emailing me your responses to the consultation questions by Friday 15th July, using this template. You do not have to answer all the questions, but any views you have will be most helpful.
